This section contains the General Terms of Use of the services offered by Orange di Paolo Donati. The updated version of the general terms is the current one, and any changes will become effective from the date of publication on the website. General Terms of Sale

Definition and purpose of the contract

The contract concluded between Orange di Paolo Donati and the customer falls into the category of distance contracts as per Articles 51 and following of Legislative Decree no. 206/2005 (Consumer Code), as amended by Legislative Decree no. 21/2014, implementing Directive 2011/83/EU.

A distance contract is defined as any contract concluded between the supplier (Orange di Paolo Donati) and the consumer (user and beneficiary) within the framework of an organized distance sales or service provision scheme that does not involve the physical and simultaneous presence of the supplier and the consumer, through the use of distance communication means (e.g., telephone, fax, web, etc.) until the conclusion of the contract (also carried out remotely).

The contract, which has as its object the sale of goods and services, is considered concluded with the acceptance, even partial, by Orange di Paolo Donati of a purchase proposal issued by the customer, via the internet, on the website www.orangesalute.com; such acceptance is considered tacit, unless specific communications are made to the customer/user.

By placing an order, which must be complete in all its parts, the Customer declares:

  • to be a consumer as defined in Article 3, paragraph 1, letter a) of the Consumer Code;
  • to be of legal age;
  • that the data provided for the execution of the contract are correct and truthful;
  • to have read and fully accepted the General Terms of Sale indicated here.

Prices

All prices of the products in the catalog on the website orangesalute.com and on any linked sites are expressed in EUROS and include VAT. They do not include, however, any taxes, duties, and fees applicable in the country of destination of the purchases (e.g. customs duties), if different from Italy (excluding the municipalities of Livigno and Campione d’Italia), which are entirely borne by the Customer.

Orange di Paolo Donati reserves the right to change the price of the items at any time, without notice, provided that the price charged to the user will be the one indicated on the website at the time of sending the order and that any subsequent changes (up or down) will not be taken into account, except for increases imposed by law regarding taxes, duties, and/or events beyond the control of Orange di Paolo Donati.

If, due to errors or other inconveniences, the price indicated on the site is lower than the correct selling price of a product, the user will be contacted to verify whether they wish to proceed with the purchase of the product at the correct price. Otherwise, the order cannot be accepted.

Warranties and Withdrawal

Purchases made on orangesalute.com are governed by Italian law on mail-order sales.

If you made a mistake in the purchase or are not satisfied, you have 15 working days from the date of delivery to exercise the right of withdrawal, i.e., the possibility of returning the product(s) and being refunded the expense. We will accept the return of the items, provided they are in like-new condition, refunding the cost incurred.

The right of withdrawal is excluded, as indicated by law, for food products or household items delivered with regular expiration; it also cannot be exercised on digital content such as eBooks, Mp3s, and downloadable Video Courses. The return is free only for purchases made in Italy.

How to request a return?

To exercise the right of withdrawal and initiate the return process of one or more items, write to us at info@orangesalute.com indicating the order number, the list of products to be returned, and the payment method used.

The organization and payment of the collection of the goods at the agreed address are the responsibility of the consumer.

Damaged products: if you receive damaged goods, notify us within 5 working days by email (info@orangesalute.com) quoting “damaged items” in the subject of the email.

Refunds

The refund is made within 10 working days from the receipt of the returned package. The refund methods are as follows:

  • If the order was paid by Credit Card, you can request the credit of the amount on your Credit Card;
  • If the order was paid by Paypal, you can request the credit of the amount on the Paypal account;
  • If the order was paid by cash on delivery, you can request the credit of the amount on your bank account via bank transfer.
  • Or you can request the refund in the form of Credit / Value Voucher to be used on Orangesalute.com.

Any civil and/or criminal dispute relating to the application, execution, interpretation, and violation of the distance sales contract will be under the territorial jurisdiction of the court of reference where the Customer has their residence or domicile, if located in the territory of the Italian state. In all other cases, the territorial jurisdiction is exclusively that of the Court of Forlì.
